The respondents were asked to file a reply in four weeks. According to Mishra's counsel Shrikant Khandalkar, the government had appointed search committees for VC selection for all universities by violating MU Act, 1994. He stated that the panels completely ignored UGC rules and regulations while short listing candidates. He said the government decision to keep UGC out of selection process is in contravention of UGC Act, 1956.
According to the petitioner, earlier, VC was selected with circumspection observed by the search committees appointed by the chancellors of the universities. Later, the coveted post was offered even to bureaucrats, judges or high ranked police officers. Citing example of Mumbai University VC Rajan Welukar, Mishra claimed that the chancellor arbitrarily handpicked him. He argued that former principal secretary of higher education JS Saharia was one of the panel members for VC selection which is illegal considering that he was directly connected with education.
They also took objection on appointment of Dr Ramchandra Deka as a member of the search committee of NU's VC. Meanwhile, in another petition filed by Mishra, challenging his removal from NU's list of approved teachers, the court issued notices to chancellor, NU VC Vilas Sapkal and registrar Mahesh Yenkie.
